1. Information We Collect
We collect different types of information to provide accurate hearing solutions and therapy.
A. Personal Identification Information
- Identity Data: Name, date of birth, age, and gender.
- Contact Data: Phone number, email address, shipping address, and billing address.
- Account Data: Username and password if you create an account on our portal.
B. Sensitive Health & Medical Information (PHI)
As Softone provides healthcare and allied audiology services, it collects and processes sensitive personal data strictly to the extent necessary for diagnosis, treatment, device fitting, and ongoing clinical care. Such data includes:
- Audiological Data: Audiograms (hearing test results), bone conduction scores, and speech discrimination scores.
- Therapy Records: Speech therapy evaluation notes, progress reports, and treatment plans.
- Device Usage Data: Where a client uses a “smart” or digitally enabled hearing aid, limited device usage data such as usage duration, volume settings, and environmental sound classifications may be collected either directly by Softone during in-clinic servicing or remote support, or through manufacturer-provided or third-party mobile applications integrated with the hearing aid. In such cases, Softone shall act as a data fiduciary only to the extent of data accessed or processed by it, while the respective application provider or manufacturer shall act as an independent data fiduciary or data processor in accordance with their own privacy policies.
- Medical History: Information regarding ear infections, surgeries, tinnitus, or other relevant medical conditions.
All sensitive health and medical data is processed only with the explicit consent of the data principal, solely for lawful healthcare purposes, and in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023.
C. Payment & Transaction Data
Softone collects and processes limited payment and transaction-related information solely for the purpose of completing purchases and maintaining financial records. Such data includes:
- Payment Information: Credit card details, UPI IDs, net banking details, or other payment instrument information processed exclusively through secure third-party payment gateways. Softone does not store full card numbers, CVV details, or authentication credentials on its servers.
- Transaction Records: Purchase history relating to hearing devices, batteries, accessories, therapy packages, and related services.
All payment transactions are subject to the terms, conditions, and privacy policies of the respective third-party payment gateway providers. Softone shall not be responsible or liable for any data breach, unauthorized access, technical failure, or security incident occurring at the level of such third-party payment gateways, provided that Softone has exercised reasonable care in selecting reputable and compliant service providers.
2. How We Use Your Information
We Softone uses personal data solely for legitimate, lawful, and necessary purposes connected with the provision and improvement of its healthcare and allied services, including the following:
- Treatment & Customization: To interpret hearing tests, program hearing aids to your specific loss, and design speech therapy curriculums.
- Order Fulfillment: To process payments, ship hearing aids, and manage returns/repairs.
- Customer Support: To provide remote adjustments (tele-audiology) or troubleshoot device issues.
- Appointment Management: To schedule, confirm, and remind you of therapy sessions or check-ups.
- Quality Improvement: To analyze service outcomes, treatment efficacy, and clinical methodologies using data that has been anonymized in a manner that permanently removes all personally identifiable elements and cannot reasonably be used to identify or re-identify any individual, either directly or indirectly. Such anonymized data is used strictly for internal research, training, and service improvement purposes.
3. Sharing of Information
We do not sell your personal data. We only share data in the following necessary circumstances:
- Hearing Aid Manufacturers: If we order a custom ear mold or a specific device from brands like Phonak, Signia, or Starkey, we must provide them with your ear impression scans and audiogram data to manufacture the device.
- Service Providers: Third-party vendors who handle shipping (couriers), payment processing, or clinic management software. They are contractually bound to keep your data secure.
- Legal Compliance: It may disclose personal data, including sensitive personal data, only where such disclosure is required under applicable law, pursuant to a valid court order, governmental directive, or regulatory requirement. Where legally permissible and not prohibited by law, Softone shall make reasonable efforts to notify the concerned data principal prior to such disclosure, or as soon as practicable thereafter, so as to enable the data principal to seek appropriate legal remedies, if any.
- Healthcare Collaboration: With your explicit consent, we may share therapy progress with your ENT specialist or primary care physician.
4. Data Storage and Security
Softone implements reasonable and appropriate industry-standard technical and organizational security measures, including encryption, firewalls, access controls, and secure server infrastructure, to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure.
- Electronic Health Records (EHR): Your medical data is stored in a secure, access-controlled digital environment.
- Retention: We retain your medical records for the duration required by local healthcare laws (typically 3–10 years depending on jurisdiction) and financial records as required by tax laws.
- Deletion and Anonymization Post-Retention: Upon expiry of the applicable retention period, and where there is no ongoing legal, regulatory, or contractual requirement to retain such data, Softone shall securely delete, erase, or permanently anonymize personal data using industry-accepted methods designed to prevent reconstruction, retrieval, or re-identification. Where deletion is not technically feasible, data shall be irreversibly anonymized and retained solely for statistical or compliance purposes.

Given that Softone provides speech therapy to children:
- We only collect data on children under the age of 18 with the explicit consent of a parent or legal guardian.
- Parents have the right to review their child's medical records and direct us to delete them, subject to medical retention laws.
